NGO as Charitable Trust

INTRODUCTION

Trust can be of various forms but the most common of them are the Charitable Trusts. A charitable trust is a one which has its object the welfare of the Public. Religious groups therefore normally use the institution of Trusts to render their charitable services to the Public in general. It is therefore common to these Trusts that some property like wells, educational institution buildings, endowments etc are rendered to the service of humanity. Though under law even an individual can, through his will, devote any of his property for such humanitarian/public causes. Although for pragmatic reasons, it  becomes imperative to create a trust, that will provide an organized body that will manage the said assets/property and ensure that it is used for the purpose it was meant for. Laws Governing Trusts is covered under The Indian Trust Act, Charitable and Religious Trust Act 1920, The Religious Endowments Act 1863 etc..

FORMATION & REGISTRATION

A  Trust is managed by its Board of Trustees of which the donor can also be a member. The trust can be created through an written instrument also called a trust deed that may require registration with the relevant Sub-registrar of properties where the Property of the Trust is located. The Board of the Trust though generally depending upon the terms of the trust Deed is empowered to devise the rules /regulations that would govern/administer the Trust. As Public Trusts are separate legal entities and their accounts are also subject to governmental Scrutiny though registration of a Public Trust is not mandatory.
